Welcome to HOA University. These Terms and Conditions govern your access to and use of the HOA University website, courses, learning paths, resources, community features, downloads, videos, certificates, subscription services, and related services available through hoa.university and any related subdomains or learning portals.
By accessing or using HOA University, creating an account, enrolling in a course, purchasing a subscription, participating in a community discussion, downloading materials, or using any part of the Website or Services, you agree to these Terms and Conditions. If you do not agree, you should not use HOA University.
HOA University is owned and operated by HOA University, LLC.
For purposes of these Terms:
“HOA University,” “we,” “us,” or “our” means HOA University, LLC and its owners, members, managers, employees, contractors, instructors, agents, affiliates, parent companies, related entities, successors, and assigns.
“Website” means hoa.university, the HOA University learning portal, and any related subdomains, pages, or online services operated by or on behalf of HOA University.
“Services” means the courses, learning paths, programs, videos, downloadable resources, community features, certificates, events, communications, subscription services, and other educational offerings provided through HOA University.
“Content” means all text, graphics, logos, icons, images, audio, video, course materials, templates, checklists, worksheets, downloads, quizzes, assessments, certificates, software, data, design elements, and other materials available through HOA University.
“User,” “you,” or “your” means any person who accesses or uses the Website or Services.
“Account” means the user profile, login credentials, enrollment information, payment information, course progress, user tags, certificates, and related information associated with your use of HOA University.
“Paid Content” means courses, learning paths, programs, resources, or other Services that require payment, subscription access, or authorized access.
“Organizational Access” means access provided through an employer, association, management company, sponsor, client relationship, group enrollment, or other approved organization or relationship.
“Community Features” means any discussion boards, feeds, forums, comments, chat tools, groups, messaging tools, or other interactive areas made available through HOA University.
HOA University provides general educational content for volunteer board members, community association leaders, committee members, managers, and others interested in community association education.
The Content is provided for informational and educational purposes only. It is not intended to provide legal, accounting, tax, insurance, engineering, reserve study, construction, financial, investment, management, or other professional advice.
You should consult qualified professionals regarding your specific association, governing documents, state law, financial matters, legal issues, insurance matters, reserves, maintenance obligations, disputes, collections, enforcement, or other association-specific questions.
Use of HOA University does not create an attorney-client, accountant-client, consultant-client, fiduciary, management, agency, or professional advisory relationship between you and HOA University, Community Association Management, or any affiliated entity.
HOA University is not an accredited college, university, trade school, professional licensing body, governmental agency, or academic institution.
Courses, learning paths, programs, certificates, badges, completion records, and other recognition issued by HOA University are for educational and informational purposes only. They do not represent academic credit, professional licensure, continuing education credit, state approval, governmental certification, legal qualification, or professional accreditation unless expressly stated in writing by HOA University.
Use of the term “University” is intended to describe an educational learning platform and does not indicate that HOA University is an accredited academic institution.
Community associations are governed by their own recorded documents, policies, contracts, applicable statutes, and board decisions. HOA University Content may not apply to every association, state, document set, contract, or factual situation.
You are responsible for confirming whether any information, form, template, checklist, example, recommendation, or course material is appropriate for your association before relying on it.
Nothing on HOA University should be interpreted as directing a board, association, manager, committee member, owner, or other person to take or avoid any specific legal, financial, enforcement, maintenance, insurance, reserve, operational, or governance action without appropriate professional review.
HOA University is intended for users who are at least 18 years old.
By using HOA University, you represent that you are at least 18 years old or are using the Website with the consent and supervision of a parent or legal guardian.
Payment information may only be provided by an adult or with the permission of an adult.
HOA University is not intended for children under 13.
You may be required to create an Account to access certain Services.
You agree to provide accurate, current, and complete information when creating or using your Account and to keep your information up to date.
You are responsible for maintaining the confidentiality of your username, password, and Account access. You may not share, sell, transfer, assign, or allow others to use your Account without our written permission.
You are responsible for all activity that occurs under your Account. If you believe your Account has been compromised, you should notify us promptly.
We may suspend or terminate your Account if we believe your Account has been misused, shared without authorization, used in violation of these Terms, or used in a way that may harm HOA University, other users, or third parties.
HOA University may offer access through different methods, including:
- Individual subscription purchase;
- Course, learning path, or program enrollment;
- Free preview access;
- Promotional access;
- Organizational Access;
- Access provided through an approved relationship, sponsor, client, or group enrollment.
Access rights may vary by user, course, program, subscription, organization, purchase, eligibility, or assigned user tag.
Access to one course, learning path, program, resource, or feature does not guarantee access to all HOA University Content.
We may add, remove, modify, reorganize, replace, or discontinue courses, programs, learning paths, resources, community features, or access options at any time.
Certain courses, learning paths, programs, resources, events, community features, certificates, or other Services may require payment or subscription access.
Prices, discounts, promotions, bundles, subscription options, and access levels may change at any time. Unless otherwise stated, the price in effect at the time of purchase will apply to that purchase.
Payment processing may be handled by third-party payment processors. By submitting payment information, you authorize HOA University or its applicable third-party payment processor to charge your selected payment method for the purchase or subscription.
You are responsible for any applicable taxes, fees, or charges associated with your purchase.
We do not store full payment card information unless expressly stated in our Privacy Policy or by the payment processor.
Some HOA University Services may be offered on a subscription basis. By purchasing a subscription, you authorize HOA University or its third-party payment processor to charge your selected payment method on a recurring basis according to the billing cycle, price, and subscription terms disclosed at the time of purchase.
Subscription fees are charged in advance unless otherwise stated. Your subscription will continue until canceled, expired, or terminated in accordance with these Terms.
You are responsible for maintaining current and accurate payment information. If a payment fails, HOA University may suspend or terminate access to the subscription, courses, learning paths, resources, certificates, community features, or other Services associated with the subscription.
HOA University may change subscription pricing, features, access levels, or billing terms upon notice where required by applicable law. Changes will apply to future billing periods unless otherwise stated.
You may cancel your subscription according to the cancellation process provided through the Website, learning portal, payment processor, or by contacting HOA University through the support method provided on the Website.
Cancellation stops future billing but does not entitle you to a refund for any subscription period that has already begun, unless required by law or expressly approved by HOA University in writing.
Some users may receive access through an organization, association, management company, sponsor, employer, client relationship, group enrollment, or other approved relationship.
Organizational Access may be limited to specific courses, learning paths, programs, users, time periods, resources, community spaces, or eligibility criteria.
Organizational Access may be modified, suspended, or terminated if:
The organization’s relationship with HOA University changes;
The user is no longer eligible for access;
The user’s role changes;
The organization requests removal;
The access period expires;
The user violates these Terms;
HOA University modifies or discontinues the applicable access program.
Organizational Access has no cash value, is not transferable, and does not create any right to a refund, credit, or substitute access.
HOA University may offer access to courses, learning paths, programs, resources, community features, certificates, and related services through subscription-based access.
Unless a different refund policy is expressly stated at the time of purchase, all subscription purchases are final once access begins. No refunds will be issued after a user’s subscription access has begun, including when the user has accessed course content, downloaded materials, participated in community features, or otherwise used the Services.
Users are responsible for canceling their subscription before the next billing date if they do not wish to continue. Cancellation will stop future billing but will not result in a refund of amounts already charged unless required by applicable law or expressly approved by HOA University in writing.
Access to subscription content may continue through the end of the then-current paid subscription period unless otherwise stated at the time of cancellation or unless access is terminated for violation of these Terms.
Organizational Access, complimentary access, promotional access, or access included through another relationship has no cash value and is not eligible for refund.
HOA University reserves the right to deny refund requests that are inconsistent with these Terms, appear abusive or fraudulent, or relate to access that has already begun.
A separate Refund Policy may be posted on the Website. If there is a conflict between this section and a product-specific refund policy, the product-specific policy will control.
All Content on HOA University is owned by HOA University, LLC, its affiliates, licensors, instructors, contractors, or other content providers and is protected by copyright, trademark, trade secret, and other intellectual property laws.

You may access and use HOA University Content only for your personal educational use or your internal board or association educational use, as permitted by your access rights.
You may not, without written permission:

Copy, reproduce, republish, or redistribute Content;

Share login credentials;

Upload Content to another website, drive, portal, LMS, AI tool, or platform;

Sell, resell, license, sublicense, rent, or commercially exploit Content;

Record, scrape, download, or extract course videos except where downloads are expressly provided;

Remove copyright, trademark, watermark, attribution, or proprietary notices;

Modify Content for distribution;

Use Content to create competing courses, resources, training programs, or commercial products.
Subject to your compliance with these Terms, HOA University grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Content made available to you through your Account.
Downloadable materials may be used for personal learning, board education, or internal association discussion, provided they are not sold, publicly distributed, posted online, or modified in a misleading way.
This license ends when your access ends or when we terminate your Account or access rights.
HOA University, the HOA University logo, Learn. Lead. Succeed., and related marks, graphics, and branding are trademarks, service marks, or trade dress of HOA University, LLC or its affiliates.
Community Association Management, Limited and related marks are the property of their respective owner.
You may not use any HOA University or affiliated brand name, logo, or mark without prior written permission.
You may be permitted to post, submit, upload, comment, message, or otherwise provide content through Community Features or other interactive areas.
You retain ownership of content you submit, but you grant HOA University a non-exclusive, worldwide, royalty-free license to host, display, reproduce, modify, excerpt, moderate, remove, archive, and use that content for operating, improving, protecting, and promoting HOA University.
You represent that you have the right to submit any content you post and that your content does not violate any law, contract, confidentiality obligation, privacy right, intellectual property right, or these Terms.
We are not responsible for user-generated content posted by other users.
HOA University may provide Community Features, discussion boards, feeds, comments, groups, messaging tools, or other interactive areas for educational discussion and learner engagement.
Community spaces are provided for general education, discussion, and peer learning only. They are not official channels for association management requests, maintenance requests, legal notices, emergency reports, account disputes, owner complaints, violation responses, collection disputes, architectural applications, board votes, or official association business.
By using any Community Features, you agree that you will not post, submit, upload, transmit, or share content that:

Is unlawful, threatening, abusive, harassing, defamatory, discriminatory, obscene, vulgar, or otherwise inappropriate;

Contains confidential association information;

Contains homeowner account information, delinquency details, collection matters, violation specifics, personal disputes, or personally identifying information of others;

Requests or provides legal advice about a specific situation;

Includes confidential board discussions, executive session topics, privileged communications, or attorney-client information;

Attempts to conduct official board votes, association business, or board decisions through HOA University;
-
Promotes vendors, products, services, or solicitations without written permission;

Contains spam, mass messaging, malware, phishing attempts, or unauthorized advertising;

Impersonates another person or misrepresents your identity, role, association, company, or affiliation;
-
Disrupts the learning environment or discourages constructive participation.
HOA University may monitor, moderate, edit, remove, archive, or decline to post user content at its discretion. HOA University may suspend or terminate community access or Account access for users who violate these Terms or who use the Community Features in a way that HOA University determines is inappropriate, unsafe, disruptive, or inconsistent with the educational purpose of the platform.
HOA University may offer certificates, badges, completion records, or other recognition for designated learning paths or programs.
Certificates are generally issued for eligible learning paths, not necessarily for every individual course. Certificate availability, requirements, assessments, completion rules, and eligibility may vary by program and may be changed by HOA University at any time.
Certificates indicate completion of designated HOA University educational content only. They do not represent academic credit, professional licensure, accreditation, certification by a governmental authority, continuing education credit, or authorization to provide legal, accounting, tax, reserve, insurance, engineering, management, or other professional services.
HOA University is not an accredited college, university, professional licensing body, or academic institution.
HOA University is designed to support learning and practical understanding. We do not guarantee that use of the Services will produce any specific result, outcome, board decision, legal compliance result, financial outcome, community improvement, management result, dispute resolution, or professional qualification.
Your results may depend on your association’s governing documents, applicable law, board decisions, management agreements, vendor contracts, professional advice, and specific facts.
HOA University may use or link to third-party platforms, tools, websites, payment processors, video hosts, community tools, analytics providers, email systems, or other services.
We are not responsible for third-party websites, platforms, content, policies, availability, security, or practices.
Your use of third-party services may be governed by those third parties’ own terms and privacy policies.
Use of HOA University is also governed by our Privacy Policy, available at:

Our Privacy Policy explains how we collect, use, disclose, and protect personal information.
We use reasonable administrative, technical, and organizational safeguards designed to protect user information. However, no website, platform, transmission, or storage system is completely secure.
You are responsible for using strong passwords, protecting your login credentials, and accessing HOA University through secure devices and networks.
HOA University is provided on an “as available” basis.
We may modify, update, suspend, discontinue, replace, or remove any part of the Website or Services at any time, including courses, programs, learning paths, videos, downloads, community spaces, pricing, certificates, subscriptions, and features.
We do not guarantee uninterrupted access, error-free operation, compatibility with every device or browser, or permanent availability of any specific course, feature, or resource.
We are not responsible for delays, outages, interruptions, data loss, or access issues caused by third-party platforms, hosting providers, internet service providers, payment processors, device issues, maintenance, security events, force majeure events, or causes outside our reasonable control.
You may not use HOA University to:

Violate any law, regulation, court order, or contractual obligation;

Infringe intellectual property, privacy, publicity, or other rights;

Share, resell, or transfer your Account or access;

Circumvent access controls, payment systems, user tags, enrollment rules, or security features;

Attempt to gain unauthorized access to other accounts, systems, data, or restricted Content;

Scrape, crawl, harvest, or extract data or Content;

Upload malware, viruses, harmful code, or disruptive technology;

Reverse engineer or interfere with the Website or Services;

Use the Services to build, train, or improve a competing product or service;

Misrepresent your identity, role, association, company, or affiliation;

Use Content in a way that suggests HOA University endorses you, your association, your business, or your services without written permission.
We may suspend, restrict, or terminate your Account or access to any Services if we believe:

Your payment failed or was disputed;

Your Organizational Access ended;

Your continued access may create risk for HOA University, other users, or third parties;

You may stop using HOA University at any time. Certain payment, refund, intellectual property, disclaimer, limitation of liability, indemnification, and dispute provisions will continue after your Account ends.
To the fullest extent permitted by law, HOA University and its Content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, security, and course suitability.
We do not warrant that the Website, Services, Content, Community Features, subscriptions, downloads, or related materials will be uninterrupted, error-free, secure, current, complete, or free of viruses or harmful components.
To the fullest extent permitted by law, HOA University, LLC, its parent companies, subsidiaries, affiliated companies, related entities, commonly owned entities, successors, assigns, owners, members, managers, officers, directors, employees, contractors, instructors, agents, licensors, service providers, sponsors, and partners, including Community Association Management and its affiliated entities, shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, business interruption, reputational harm, association disputes, board decisions, owner claims, vendor claims, legal claims, financial losses, maintenance issues, enforcement disputes, collection disputes, or other damages arising out of or relating to your use of or inability to use HOA University, the Website, Services, Content, Community Features, subscriptions, or downloadable materials.
To the fullest extent permitted by law, the total liability of HOA University and the parties listed above for any claim arising out of or relating to the Website, Services, Content, Community Features, downloadable materials, subscriptions, or these Terms shall not exceed the amount you paid to HOA University for the specific Service giving rise to the claim during the three months before the event giving rise to the claim, or $100, whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
You agree to defend, indemnify, and hold harmless HOA University, LLC, its parent companies, subsidiaries, affiliated companies, related entities, commonly owned entities, successors, assigns, owners, members, managers, officers, directors, employees, contractors, instructors, agents, licensors, service providers, sponsors, and partners, including Community Association Management and its affiliated entities, from and against any claims, demands, damages, liabilities, losses, costs, expenses, judgments, settlements, fines, penalties, and fees, including reasonable attorneys’ fees, arising out of or relating to:

Your use of the Website, Services, Content, Community Features, subscriptions, or downloadable materials;

Your violation of these Terms;

Your user-generated content;

Your violation of any law, regulation, contract, confidentiality obligation, privacy right, intellectual property right, or third-party right;

Your misuse, copying, sharing, distribution, or commercial use of HOA University Content;

Any action or decision taken by you, your board, your association, your company, or your organization based in whole or in part on HOA University Content;

Any association dispute, owner dispute, board dispute, vendor dispute, legal claim, financial claim, maintenance issue, enforcement matter, collection matter, or governance issue connected to your use or misuse of the Services.
We may update these Terms from time to time. The updated version will be posted on the Website with a revised “Last Updated” date.
Your continued use of HOA University after updated Terms are posted means you accept the updated Terms.
If we make material changes, we may provide additional notice, such as email notice or a notice within the learning portal.
These Terms and any dispute arising out of or relating to HOA University, the Website, Services, Content, Community Features, subscriptions, downloadable materials, or your use of them shall be governed by the laws of the State of North Carolina, without regard to conflict of law principles.
Any legal action or proceeding shall be brought in the state or federal courts located in Mecklenburg County, North Carolina, unless otherwise required by applicable law.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed from these Terms. The remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, sale of assets, restructuring, change in control, or by operation of law.
These Terms, together with the Privacy Policy, Refund Policy, Community Rules, and any product-specific terms presented at enrollment or purchase, constitute the entire agreement between you and HOA University regarding your use of the Website and Services.
